Court Finds Nothing to Support Harassment Claim Against Landlord

Tenant, who lived in a basement apartment, sued landlord, claiming harassment. Tenant previously had a friendly relationship with landlord, who lived upstairs. Tenant claimed that landlord yelled, cursed, and threatened her, held back mail, and turned off the hot water. Tenant called police on several occasions. Landlord denied tenant's claims and noted that she stayed away from tenant after tenant obtained an interim order to cease and desist.

The court ruled against tenant, finding no supporting evidence of acts or omissions by landlord intended to cause tenant to leave the apartment. The court found that landlord simply asked tenant to wear a mask if visiting landlord upstairs, but that tenant refused. The case was dismissed.
