Condo Board Didn't Offer Storage Bins to Rent-Stabilized Tenants

Landlord condominium building owner provided the condo unit owners with storage bins without offering this service to rent-stabilized tenants. Tenant asked the DHCR if this was permissible. Tenant indicated that no tenants had had storage bins for the past three years and that there were no lease provisions for storage bins. In an opinion letter, the DHCR said that landlord may be improperly discriminating against rent-stabilized tenants.

In an opinion letter, the DHCR said that landlord may be improperly discriminating against rent-stabilized tenants. General Business Law Section 352-eeee states that a condo managing agent "shall provide to non-purchasing tenants all services and facilities required by law on a non-discriminatory basis."
