Landlord Didn't Offer Renewal Lease to Rent-Stabilized Tenant

The DRA set the legal rent for rent-stabilized tenant's apartment at $272 as of June 30, 1999. This rent included deemed rent increases for certain periods. Tenant appealed, claiming that landlord knew he was rent stabilized and didn't offer renewal leases. So, tenant said, landlord wasn't entitled to any deemed renewal increases. The DHCR ruled for tenant. Landlord filed a report of statutory decontrol in 1977 and later filed a rent restructuring application with CAB in 1979. Landlord knew the apartment was rent stabilized and didn't offer renewal leases.
