Apartment Used for Illegal Purposes

LVT Number: 18112

Landlord sued to evict tenant for drug trafficking from her apartment. The court ruled for landlord. Tenant appealed and lost. Police searched tenant's apartment using a search warrant. They found two bags of marijuana, some cocaine residue, and a loaded handgun. Tenant's boyfriend admitted he lived in the apartment and pleaded guilty to possession of the drugs. So the trial court properly found that the apartment was being used for illegal purposes, and that tenant knew or should have known of her boyfriend's activities, and permitted them to continue.
