Apartment Used for Illegal Purposes

LVT Number: 7074

The New York District Attorney's office sued to evict tenant for illegal use of her apartment. The trial court ruled against tenant, and tenant appealed. The appeals court ruled that tenant could be evicted. Police got a search warrant and found glassine envelopes containing marijuana, a small scale, a cocaine vial, and $675 in small bills in the apartment. Tenant's 18-year-old grandson lived with her. Tenant claimed she knew nothing about the drugs. This wasn't believable because the drugs and paraphernalia were found all over the apartment, including tenant's bedroom.
