Work Done to Correct Violations

Tenant complained of a rent overcharge. Landlord claimed that he'd made renovations costing $8,500 and spent another $5,000 correcting violations. The DRA ruled for tenant, and ordered landlord to pay tenant over $9,000, including triple damages. Landlord appealed. The DHCR agreed with the DRA that landlord was entitled to a small rent increase for installing a new bathtub. Otherwise, landlord wasn't entitled to any rent increase for the $5,000 spent to correct 17 code violations. And, landlord's proof of the work done was inconsistent and incomplete. Landlord's PAR was dismissed.
