Waterproofing Done Within One Month of Pointing

Landlord applied for MCI rent increases based on roof installation, pointing, and waterproofing. The DRA disallowed any increase for the waterproofing, and landlord appealed. The DHCR ruled for landlord. Waterproofing qualifies as an MCI when done in conjunction with pointing. The waterproofing began within one month of completion of the pointing. Since the two installations were done within a reasonable time of one another, the waterproofing qualified as an MCI.
