Violations Weren't Second Offenses

The Fire Department issued violation notices to landlord for not correcting previously cited violations. Landlord claimed that it wasn't the same landlord as was named in the prior violation notice. The ALJ ruled against landlord and fined it for second offenses. Landlord appealed and won. There was no proof that landlord was same entity as prior landlord. The fines were reduced to first-offense level fines.
