Useful Life of Prior Intercom Hadn't Expired

Landlord applied for MCI rent hikes based on the installation of a new intercom system. The DRA ruled for landlord. Tenants appealed and won. The DHCR had issued a prior MCI increase order for an intercom installed in 1987. Under the Rent Stabilization Code and DHCR policy, the useful life of an intercom system is 15 years. The new intercom system was installed in 1999, which was less than 15 years later. Landlord sought no useful-life waiver before filing its new MCI application. So no rent increase could be collected for the new intercom system.
