Useful Life of Prior Boiler Didn't Matter

The DRA granted landlord's application for MCI rent hikes based on installation of a new boiler/burner. Tenants appealed and lost. Tenants argued that the new boilers were installed before the expiration of the useful life of the building's prior boilers. But landlord never applied for MCI rent hikes for any boiler installation. So the useful life of the prior boilers didn't matter. Landlord was entitled to the MCI rent hike. [Download PDF of decision here.]
