Tenant's Domestic Partner Gets Apartment

The DRA ruled that occupant had pass-on rights to tenant's rent-stabilized apartment. Landlord appealed and lost. Occupant submitted sufficient proof that she was a nontraditional family member, entitled to pass-on rights after tenant moved out.

The DRA ruled that occupant had pass-on rights to tenant's rent-stabilized apartment. Landlord appealed and lost. Occupant submitted sufficient proof that she was a nontraditional family member, entitled to pass-on rights after tenant moved out. Her proof included copies of passbook pages of a joint bank account opened in 1992, a letter from a neighborhood organization in 2000 stating that the occupant had a family-type relationship with tenant in the apartment from 1988 until tenant moved out in 1997, and a letter from a civic organization stating that occupant had lived in the apartment since 1988 and that tenant moved out under a court order based on spousal abuse. Tenant also submitted sworn statements from three other people that she had lived in the apartment as tenant's domestic partner.
