Tenant's Domestic Partner Gets Apartment

Tenant's roommate complained that landlord refused to give him a renewal lease after rent-stabilized tenant died. Roommate claimed that he was tenant's domestic partner and that he had primarily resided in the apartment with tenant since 1978, until tenant died in 2002. The DRA ruled for roommate. Landlord appealed and lost. Roommate presented sufficient proof that he had an emotional and financial commitment with tenant. He qualified as a family member under the Rent Stabilization Code and was entitled to pass-on rights.
