Tenants Deregulated Based on High Rent, High Income

Landlord applied for destabilization of tenants' apartment because the monthly rent was over $2,000 and, landlord claimed that tenants' annual household income was over $250,000 for the past two years. The DRA ruled for landlord, and tenants appealed. Tenants claimed that they rented two separate apartments and that the rent for each unit was less than $2,000. The DHCR ruled against tenants. Landlord showed that tenants moved into the duplex apartment in 1970. Landlord submitted a 1969 certificate of occupancy and copies of tenants' leases showing that the unit was one apartment.
