Tenants Deregulated Based on High-Rent/High-Income

LVT Number: #26447

Landlord applied in 2010 for high-rent/high-income deregulation of tenants’ rent-stabilized apartment. The DRA ruled for landlord after finding that tenants’ total annual household income was more than $175,000 in 2008 and 2009. Tenants appealed and lost. Tenants claimed that their household income was below the deregulation threshold.  But DTF records showed that tenants’ income exceeded the threshold for both years. Based on tenants’ response, the DHCR verified the income information with DTF more than once and had no obligation to verify any further.
