Tenant's Boyfriend Engaged in Drug Activity

LVT Number: 12350

Landlord sued to evict tenant based on her boyfriend's sale of drugs in the building's lobby. Tenant testified that she had ended her relationship with this boyfriend in early 1996. Although she occasionally accepted mail addressed to him at the apartment, she no longer permitted him to visit her there and he'd removed all of his belongings. Landlord didn't claim that tenant herself was involved in the drug sales. The court ruled against landlord and dismissed the case.

Tenant's testimony was believable, and the drug activity her former boyfriend was charged with didn't begin until well after early 1996. Tenant wasn't responsible for her former boyfriend's activities in the building.
