Tenant Was Hired as Super

Landlord sued to evict building superintendent after his employment ended. The super claimed that he was a tenant who was otherwise entitled to stay in the apartment. The court ruled for the super. Landlord appealed and lost. The super showed that he had moved into the apartment in landlord's building before the prior super quit. He was then hired as the super. So the super had been a tenant first, and landlord had to send him a 30-day termination notice before starting an eviction action against him.
