Tenant Not Responsible for Paying Terminated Section 8 Subsidy

Landlord sued to evict rent-stabilized tenant for nonpayment of rent. NYCHA had suspended tenant's Section 8 rent subsidy, which was paid under a public housing authority housing assistance program (HAP) contract. Landlord then sought the unpaid Section 8 share of rent from tenant. Tenant claimed that he wasn't responsible for paying the terminated subsidy. The court ruled for tenant and dismissed the case. NYCHA terminated subsidy payments to landlord because tenant's apartment had failed inspection, not because of any act on tenant's part.
