Tenant Moves into Different Building

LVT Number: 10096

Tenant lived in a rent-stabilized apartment and had a separate rent-stabilized lease for garage space in the building. Tenant asked the DHCR if she would still be entitled to renewal leases for the garage space if she moved into a co-op building across the street. In an opinion letter the DHCR said no. If tenant moved to the co-op, she would be exempt from rent stabilization. Landlord wouldn't be required to offer her a garage renewal because she would no longer be landlord's, or any other landlord's, rent-stabilized tenant.
