Tenant Didn't Renew Section 8 Lease

LVT Number: 13643

Landlord sued to evict tenant for not renewing her lease. Tenant had gotten a rent subsidy until NYCHA decided not to renew the Section 8 rental agreement for the building. The Section 8 agreement wasn't renewed because landlord didn't correct hazardous building conditions. NYCHA argued that since the failure to renew the lease was due to landlord not making repairs, landlord didn't have good cause to seek eviction of tenant. The court ruled for landlord.

While the court didn't approve of landlord's failure to make repairs, it would be unfair to bar landlord from bringing an eviction case against tenant who refused to renew her lease.
