Tenant Didn't Allow Installation of New Windows

Tenant complained of a rent overcharge. The DRA ruled for tenant but allowed a small rent increase for 1/40th of the cost of vacancy improvements made to tenant's apartment before tenant moved in. Tenant appealed, claiming that landlord didn't install new windows. The DHCR ruled against tenant. Landlord submitted proof of payment for the windows and claimed that they were made to measure for tenant's apartment.

Landlord submitted proof of payment for the windows and claimed that they were made to measure for tenant's apartment. Landlord also claimed, and tenant didn't deny, that tenant didn't permit installation, and that the windows were still stored in the building for future installation in the apartment. The windows were a unique size and couldn't be used elsewhere.
