Tenant Claims She Wanted Larger Refrigerator

Tenant complained of a reduction in services. She claimed that landlord gave her a replacement refrigerator which was smaller than her original one. The DRA ruled against tenant, and she appealed. The DHCR again ruled against tenant. Landlord provided tenant with a refrigerator. Landlord informed tenant that she could have a new, frost-free larger refrigerator if she paid a 1/40th rent increase for new equipment. Otherwise she was entitled to another used refrigerator, which was what she got. Tenant never responded to landlord's two written notices advising her of her options.
