Tenant Claims Landlord Reduced Apartment Size

Rent-stabilized tenant complained of a reduction in services based on alterations to his bathroom that he claimed significantly reduced apartment space. The DRA ruled against tenant who appealed and lost. Tenant claimed that landlord was supposed to remove a bathroom window and install a ventilation fan. But landlord went beyond that, reducing the overall floor space in the apartment and removing a second window in the kitchen.

The DRA ruled against tenant who appealed and lost. Tenant claimed that landlord was supposed to remove a bathroom window and install a ventilation fan. But landlord went beyond that, reducing the overall floor space in the apartment and removing a second window in the kitchen. The DRA had dismissed the complaint because it couldn't verify that the apartment had in fact been significantly altered in size, but stated that tenant could refile in the future. At the time, tenant was unable to obtain a pre-2006 floor plan from DOB. Tenant had done so since then but must file a new complaint.
