Tenant Can't Challenge Apartment Improvement Costs

Rent-stabilized tenant complained of a rent overcharge. The DRA found no overcharge and dismissed the complaint. Tenant appealed and lost. Landlord had submitted proof of individual apartment improvements for which the DRA granted a rent increase. Tenant disputed landlord's description of the amount of work done in the apartment before tenant moved in. But tenant didn't raise this claim before the DRA. Tenant can't challenge the 1/40th improvement costs for the first time on appeal.
