Tenant Can't Appeal Rent Overcharge Finding

Rent-stabilized tenant complained of rent overcharge. The DRA ruled for tenant. Tenant appealed, claiming that landlord hadn't complied with the DRA's order by not fully refunding the overcharge. The DHCR dismissed tenant's PAR. The only grounds for an appeal of the DRA's order were for errors of law, fact, or overcharge calculation. The fact that landlord hadn't refunded the overcharge wasn't a valid basis for tenant's appeal of the rent overcharge determination.
