Tenant Accepted Renewal Offer on Time

Tenant complained that landlord didn't renew her rent-stabilized lease on time. The DRA ruled against tenant and dismissed the complaint based on the fact that landlord had sent tenant a termination notice for failure to accept her renewal lease. Tenant appealed, claiming that she had accepted landlord's renewal lease offer on time. Tenant received the renewal offer on July 14, 2004, and responded by Sept. 7, 2004. This was within the 60-day deadline to respond.

Tenant appealed, claiming that she had accepted landlord's renewal lease offer on time. Tenant received the renewal offer on July 14, 2004, and responded by Sept. 7, 2004. This was within the 60-day deadline to respond. Tenant also showed that landlord had sent the renewal lease back to her without signing it and that tenant redelivered the lease to landlord. The DHCR ruled for tenant. Since tenant showed that she accepted the renewal offer on time, the DRA should have ruled for her.
