Temporary Labor Cost Adjustment Deducted from MBR

Landlord applied for MBR rent increase for rent-controlled tenant's apartment. The DRA ruled that tenant's MBR as of Jan. 1, 2003, was $622. Landlord appealed. Landlord claimed that the DRA incorrectly removed the temporary labor cost increase of $3.50 granted under a 1983 DHCR order. The DHCR ruled against landlord. Landlord didn't submit a Labor Cost Modification Sheet for the first year of the cycle immediately following the cycle for which the temporary labor cost adjustment had been granted.
