Subtenant's sublease had expired, and he had signed a surrender agreement saying he would move out by the end of 1999. Subtenant wasn't covered by rent stabilization, so he couldn't claim that he had rights that couldn't be waived. The building was previously commercial and was substantially rehabilitated for residential use in 1986.
