Steam Traps and Piping Work Didn't Qualify as MCI

The DRA granted landlord's application for MCI rent hikes based on a boiler/burner installation but denied any rent increase for steam traps and piping work. Landlord appealed and lost. Landlord claimed that this work was done in connection with the boiler/burner installation. Landlord removed and replaced undersized steam traps and piping with the proper size, and replaced a leaking section of the steam piping. Invoices for this work dated Nov. 14, 2004; Jan. 5, 2005; and Jan. 28, 2005; indicated that the work was performed piecemeal and not as part of a consecutively timed project.
