Stained Wood Floor and Bathroom Vent Dust Weren't Minor Conditions

Rent-stabilized tenant complained of a reduction in services. The DRA ruled for tenant and reduced his rent based on a wooden parquet floor that was stained and worn out, as well as excessive accumulation of dust in the bathroom wall vent. Landlord appealed and lost. Landlord claimed that these conditions were de minimis--that is, minor--and didn't warrant a rent reduction. The conditions weren't minor.

The DHCR's inspection report stated that on the bathroom wall vent, dust was accumulated, and that the parquet wood floor was stained and worn in areas throughout the living room.
