Son Can't Get Rent-Stabilized Apartment

Rent-stabilized tenant’s son complained that landlord refused to give him a renewal lease after tenant moved out. The DHCR ruled for the son despite landlord’s argument that the son hadn’t proved when tenant moved out or that he had lived with tenant for two years before she did so. Landlord filed an Article 78 court appeal, and the DHCR agreed to reconsider the case.

Rent-stabilized tenant’s son complained that landlord refused to give him a renewal lease after tenant moved out. The DHCR ruled for the son despite landlord’s argument that the son hadn’t proved when tenant moved out or that he had lived with tenant for two years before she did so. Landlord filed an Article 78 court appeal, and the DHCR agreed to reconsider the case. The DHCR found that the son’s documentation was insufficient. In some documents, the son claimed that tenant moved out either in 2001 or 2004. Later he claimed she moved out in May 2010. The son’s driver’s license was issued only in 2009. His 2007 and 2008 tax returns listing the apartment as his address were unsigned, and there was no proof of filing. Letters from the son’s bank and employer didn’t state where he lived.
