Section 8 Tenant Responsible for Entire Unpaid Rent

Landlord sued to evict Section 8 tenant for nonpayment of rent. The court ruled for landlord based on tenant's failure to appear in court and awarded landlord a judgment for $4,600 in back rent. Tenant later asked the court to vacate the default judgment. She had moved out and claimed that NYCHA owed landlord most of the Section 8 back rent. The court ruled against tenant. Review of NYCHA records showed that NYCHA had terminated tenant's Section 8 benefits based on tenant's failure to properly recertify for benefits. The back rent owed had accrued after termination of the benefits.
