Respondent's Name Not in Box

DOB issued a violation notice to landlord for not maintaining an elevator in good condition. The ALJ ruled for landlord and dismissed the violation because DOB didn't fill in landlord's name on the violation notice. DOB appealed, claiming that its inspector had placed landlord's name in another box on the violation notice instead of in the space provided immediately below the word ''Respondent.'' The ECB ruled for DOB and reopened the case. Placing landlord's name in the wrong box on the violation notice didn't hurt landlord's ability to respond to the notice.
