Respondent's First Name Missing in Violation Notice

LVT Number: 13172

DOB issued a violation notice to landlord for not maintaining an elevator. The violation notice identified the respondent as ''Maidan,'' without identifying a first name. Landlord claimed the notice didn't properly identify the respondent. The ALJ ruled for landlord and dismissed the violation. DOB appealed, pointing out that Maidan was the last name of the president of the corporate owner of the building. ECB ruled for DOB and fined landlord $360. Unless omitting respondent's first name created confusion, the violation notice itself remained valid.
