Replacement of Skylights and Roof Hatch Doesn't Qualify

Landlord applied for MCI rent hikes based on the replacement of skylights and a roof hatch. The DRA ruled against landlord. Landlord appealed and lost. The DHCR's policy is that skylights and roof hatches must be done in connection with an MCI, such as a new roof installation, to qualify for a rent hike. Landlord replaced the roof in 2000. Landlord didn't replace the skylights and roof hatch until 2003 and used a different contractor. So the work wasn't connected to an MCI and didn't qualify.
