Repairing Damage Caused by Rent-Controlled Tenant

Landlord asked the DHCR if it had to file with the DHCR before charging rent-controlled tenant for repairing an item that tenant damaged. In an opinion letter, the DHCR said yes. Rent control regulations state that landlord must repair or correct any required services that are damaged. If tenant caused the damage, landlord can apply for a temporary increase in the maximum rent based on the cost of restoring the item.
