Rent Hike Granted for Replacement Staircase and Staircase Painting

Landlord applied for MCI rent hikes based on installation of a replacement staircase and related work. The DRO ruled for landlord in part, granting an increase for the stairs but disallowing the cost of prime and paint for the door and frame as well as for replacement of all the wood trim around windows in the staircase, the paint of all exposed steel elements for the new stairs, and paint for all hallways including doors and frames. Landlord appealed and won, in part.

The DRO ruled for landlord in part, granting an increase for the stairs but disallowing the cost of prime and paint for the door and frame as well as for replacement of all the wood trim around windows in the staircase, the paint of all exposed steel elements for the new stairs, and paint for all hallways including doors and frames. Landlord appealed and won, in part. The painting of the staircase was necessary work performed in connection with, and directly related to, a qualifying major capital improvement. The monthly per-room rent increase was increased from $19.65 to $20.75.
