Prior Landlord's Managing Agent Responsible for Portion of Overcharge

Landlord appealed, claiming that the DRA didn't apportion liability for overcharge collected between November 1980 and May 1985 between current and prior landlord. The DHCR ruled for landlord. The managing agent for prior landlord was also deemed to be the ``owner'' for purposes of apportioning responsibility for refund of overcharge under the Rent Stabilization Code's definition of owner as any person or entity who receives or is entitled to receive rent.
