Notice of Complaint Sent to Prior Managing Agent

Rent-stabilized tenants complained of a reduction in building-wide services. The DRA ruled for tenants and reduced their rents. Landlord appealed, claiming that its current managing agent never got notice of the case. Instead, the complaint was sent only to landlord’s prior managing agent. The DHCR ruled against landlord. Landlord’s prior managing agent answered the complaint on landlord’s behalf, and the DRA’s ruling was based on a DHCR inspection.

And although the new managing agent claimed that it had filed a general notice of change in managing agent with the DHCR while the case was pending, there was no proof of this.
