Pointing and Waterproofing Work Qualify

Landlord applied for MCI rent hikes. The DRA denied landlord's application, finding that the pointing and waterproofing work done where necessary at the building didn't qualify as an MCI. Landlord appealed. The DHCR's policy is that comprehensive pointing and waterproofing on exposed sides of a building qualifies as an MCI. Landlord showed that its contractor had examined all exposed surfaces of the building before the work was done and that all necessary work was performed. The DHCR granted landlord's application; the work done wasn't mere spot patching.
