Parking Space Is Ancillary Service

Rent-stabilized tenant complained of a rent overcharge when landlord increased her monthly garage rent from $60 to $125. The DRA found no rent overcharge since tenant didn't pay the increase, but ruled that her parking space was an ancillary service subject to rent guidelines increases. Landlord appealed and lost. Landlord claimed that the garage space wasn't rent stabilized but offered no proof. Tenant's garage space was an ancillary service under Rent Stabilization Code Section 2520.6(r)(3).
