Landlord sued to evict tenant for nonprimary residence. Landlord claimed that tenant lived in another apartment nearby. The court ruled for landlord, and tenant appealed. The appeals court also ruled for landlord. A recent occupant who had signed an apartment-sharing agreement with tenant testified that he lived in the apartment alone. And landlord proved that tenant and his wife lived in an adjoining building.
