Landlord sued to evict tenant for nonprimary residence. Tenant claimed that landlord's court papers were defective. The court ruled for tenant and dismissed the case. Landlord appealed. The appeals court ruled for landlord and sent the case back for a trial. Landlord's nonrenewal notice stated the other address at which it claimed tenant lived as a primary residence as well as the names of current occupants of the apartment. Landlord's notice sufficiently set forth the facts upon which its proceeding was based.
