Nonrenewal Notice Not Required for Loft Tenant

Landlord sued to evict loft tenant for nonprimary residence. Tenant claimed that the case should be dismissed because landlord didn't send him a notice of nonrenewal of lease. The court ruled against tenant. Tenant appealed and lost. The loft building was still an interim multiple dwelling and hadn't yet become subject to rent stabilization. So the procedures that applied to rent-stabilized tenancies, including the requirement to send a nonrenewal notice, didn't apply to the loft building.
