Nonrecyclables Placed in Recycling Container

DOS issued a violation notice to landlord for improperly placing nonrecyclables in a recycling container. Landlord argued that a passerby must have done this after the recyclables had been collected. A DOS officer stated at a hearing that the trash hadn't been collected at the time he issued the violation. The ALJ ruled against landlord and fined him $25. Landlord appealed and lost. Landlord didn't prove that it wasn't responsible for not properly sorting the trash.
