Nonrecyclables Placed in Recycling Container

DOS issued a violation notice to landlord for improperly placing nonrecyclables in a recycling container. Landlord claimed that there was no violation when she put the trash out and that passersby must have put other trash in the blue recyclables container. The ALJ ruled against landlord and fined her $50. Landlord appealed and lost. There was no proof that someone other than landlord, the super, or building tenants put the nonrecyclables in the recycling container.
