Noisy Radiators

Rent-stabilized tenant complained of a reduction in services. Among other things, he said the radiators in his apartment made a banging noise when the heat was on. The DRA ruled for tenant and ordered landlord to fix the radiator condition. Landlord appealed, claiming that the DRA didn't inspect the apartment, that a prior rent agency's order had dismissed tenant's complaint, and that the radiators in the apartment had been replaced. The DHCR ruled against landlord. The DHCR inspector had reported that the radiators in two bedrooms were making excessive noise.

The prior order was issued in 1988 and tenant's new complaint was filed in 1992. Tenant could file a new complaint in a new heating season if the problem reoccurred.
