No Prior Notice to Landlord About Defective Condition

Tenant complained of a reduction in services. The DRA ruled for tenant and reduced his rent based on an inspection that found a cracked windowpane in tenant's apartment. Landlord appealed, claiming that tenant never notified landlord about the complained-of condition before filing his complaint with the DHCR. The DHCR ruled for landlord. Before filing a complaint, tenant must first notify landlord in writing of all service problems listed in the complaint. The letter tenant claimed it sent to landlord before filing his complaint was sent to the wrong address and never received by landlord.
