Landlord Corrected Original Defective Condition

Tenant complained of a reduction in services. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that all conditions claimed in tenant's complaint had been repaired before the DHCR inspection. The DHCR ruled for landlord. After landlord answered tenant's complaint and stated that all repairs were done, tenant replied that the closet door tracks remained broken. Landlord submitted a work order signed by tenant acknowledging that the closet door tracks were repaired.

The DRA sent this document to tenant and asked him to comment within 21 days or the case would be dismissed. Tenant didn't respond. Although a DHCR inspection two months later showed the closet door tracks to be defective, this should have been considered a new condition. Landlord had submitted sufficient proof that original conditions complained of had been repaired.
