New Roof Surface Qualifies as MCI

LVT Number: 19671

Landlord applied for MCI rent hikes based on the installation of a new roof. The DRA ruled for landlord. Tenant appealed, claiming that the roof work done was merely general repair work required because a top-floor tenant had complained of leaks. The DHCR ruled against tenant. Landlord installed a new modified bitumen SBS roofing membrane system, with cold adhesive to the roof. This work qualifies as an MCI.
