Landlord asked the DHCR if the installation of carpeting on an apartment's bedroom plywood floor would constitute an individual apartment improvement for which landlord could collect a 1/40th rent increase. In an opinion letter, the DHCR said yes. If the work was done during a vacancy, no tenant consent was needed. Landlord should maintain invoices and proof of payment for any 1/40th work performed, in the event of an overcharge claim.
